By accessing or using Flurb ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Flurb is an AI-powered image generation service that creates personalized meme-style images. We utilize various third-party large language model (LLM) providers to generate images based on your inputs, including uploaded photos and text descriptions. We facilitate image creation through prompts designed to best accomplish the desired effect.

3. User Accounts

You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Upload images or enter text that violates the laws of your jurisdiction
• Submit content that is abusive, offensive, harassing, or promotes violence
• Attempt to circumvent any content filtering or security measures
• Use the Service to generate content that infringes on others' intellectual property rights
• Use the Service in any way that could damage, disable, or impair the Service

While we do not actively censor content, our third-party AI model providers may refuse to process objectionable content, which may result in failed image generation. You will not receive refunds or credit for failed generations due to content policy violations.

5. Credits and Payments

The Service operates on a credit-based system. Credits may be purchased as one-time packages or through subscription plans. By purchasing credits, you agree to the following:

• Purchased credits do not expire
• Subscription credits are allocated monthly and unused subscription credits may roll over according to your plan terms
• No refunds will be issued for unused credits
• Credits are non-transferable between accounts

6. Generated Content

You acknowledge and agree that:

• AI-generated images may produce unexpected, imperfect, or occasionally inappropriate results
• We are not responsible for improper or offensive results that may be initiated by your supplied image(s) and text inputs
• The quality and accuracy of generated images depend on the inputs you provide and the capabilities of third-party AI models
• You are solely responsible for how you use and distribute any images generated through the Service

7. Service Availability

We strive to maintain consistent service availability but do not guarantee uninterrupted access. We are not responsible for service outages, whether planned or unplanned. Credits will not be refunded or extended due to website downtime or service interruptions.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. This includes, but is not limited to, violations of these Terms or conduct that we determine to be harmful to other users, us, or third parties.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Flurb, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by posting a notice on our website. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
